Role:The Manager Customs Trade Compliance for ensuring Quality Handling of all Compliance and Customs matters within Europe in line with local legislation and Global Regional Customs Policy.Compliance is a crucial pillar for Fabory's growth ambitions. The compliance function plays a vital role in ensuring adherence to laws and regulations within the organization, contributing to the efficiency and reliability of the business prcoesses. Fabory is rapily growing, and as such, the compliance function is in its nascent stage. There is a significant opportunity to build this function from the ground up.This role is a focal point supporting relevant Trading Supply line of business for all customs related matters and activities ensuring full compliance with appicable customs regulations and internal requirements in an optimal and efficient manner.Job Description:The Manager Customs Trade Compliance (MCTC) at Fabory is responsible for ensuring that all business activities comply with national and international laws and regulations. This involves overseeing internal processes, communicating with regulatory authorities suppliers, and supporting the organization on compliance matters. The (MTC) plays a key role in maintaining the integrity and efficiency of Fabory's operations and supply chain in strict alignment with global and local trade legislation.Main Responsibilities:
  • Implement and manage Fabory Trading Customs policies and processes based on best practices and framworks (within the framework of AEO qualifications).
  • Specific implementation of controls regarding non-Pref and Pref origin, management (including controls od COO) as well as management of products affected by trade defense measures (antidump, dual use, antisubsidy, CBAM, Russian Sanctions, denied party screening).
  • CBAM-legislation and reporting.
  • Specific implementation of controls regarding customs classification of commodities traded bij Purchasing in accordance with global and regional policies.
  • Support import/export ops within Europe and Export non-EU countries including cooperation with customs brokers/agent and HO/Entities in Benelux.
  • Ensure that all aspects of Fabory's operations comply with international and local laws and regulations related to compliance.
  • Coordinate activities with customs brokers to ensure efficient and compliant customs clearance processes.
  • Oversight of customs authorities requirement in Europe and customs documentation needed to support Fabory Trading flow of goods, including building internal compliance documentation guidelines, training resources, and providing inport/export compliance support to operations teams.
  • Ensure import trade flows and operations are compliant (pre-entry and post-entry review) and correct customs licenses, approvals are in place for aperational changes.
  • Recommend measures to secure the optimum import duty regime within the region through Customs Warehousing and Inward Processing, End-use relief.
  • Organize, Plan and Collaborate on internal audits, risk assessment and other assurance activities.
  • Liaise with IT team to enhance Compliance aspects within the Fabory IT environment/ ERP system and trading platforms.
  • Standardize and overview of Fabory Trading compliance procedures and controls in locations abroad.
  • Keep updated with regulatory changes and best practices; identify risks and apportunities and recommend actions.
  • Assist Indirect Tax team in the review od third-party compliance profile and customs licenses.
  • Work with the Trade team and Indirect tax to remedy any potential non-compliance or concerns including breaches.
  • Set-up a control framework for customs brokers used by the company to assist operational team with local customs compliance work.
  • Advise traders and operators on the tax treatment of commodity transactions (Customs and/or Excise compliance).
  • Identify, capture, collect, monitor key metrics (KPI's) for development of business strategies and presentation to management and relevant optimization projects.
  • Develop and carry out Compliance traning for traders, operators and local personnel raising awareness on the Compliance function and risks.
  • Serve as the main point of contact for regulatory authorities on compliance issues.
  • Provide support and advice to the organization on compliance-related topics.
  • Propose and implement plans for operational improvements and process optimizations.
  • Build and establish a robust compliance platform to streamline compliance across the organization to foster a culture of compliance.
  • Create internal awareness about the importance of compliance and its impact on Fabory's competitiveness.
